By creating an account or using MaxUpgrade, you agree to these Terms of Service. If you do not agree, do not use the service. We may update these terms from time to time. Continued use after updates constitutes acceptance.
MaxUpgrade is an AI-powered self-improvement platform that provides tracking, analytics, and AI coaching across fitness, nutrition, mindset, habits, finance, goals, business, and appearance pillars. The AI coach (Eve) is powered by Anthropic's Claude API and generates responses based on your logged data.
MaxUpgrade is a tool to support your self-improvement efforts. It is not a substitute for professional medical, nutritional, financial, or psychological advice. Always consult qualified professionals for decisions that affect your health, finances, or wellbeing.
MaxUpgrade does not guarantee any specific fitness, financial, or personal development results. Individual outcomes vary based on effort, consistency, and individual circumstances.
You must be at least 18 years old to use MaxUpgrade. By creating an account, you confirm that the information you provide is accurate. You are responsible for maintaining the security of your account and password. Notify us immediately at maxupgradeteam@gmail.com if you believe your account has been compromised.
We do not knowingly collect data from anyone under 18. If we discover that a user is under 18, their account will be terminated and their data deleted.
You may not create accounts for others without their permission, share your account credentials, or use the service for any unlawful purpose.
MaxUpgrade offers three subscription plans: Founder ($19/month, limited to 200 users), Pro ($29/month with a 7-day free trial), and Annual ($199/year). All prices are in USD.
Pro plan subscribers receive a 7-day free trial. Your card will be charged at the end of the trial period unless you cancel before day 7. Founder and Annual plans are charged immediately upon subscription.
Founder pricing is locked at $19/month for the lifetime of your subscription, provided you remain subscribed. If you cancel and resubscribe, Founder pricing is no longer guaranteed.
Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer prorated refunds for partial billing periods.
If you cancel during your 7-day Pro trial, you will not be charged. For annual plans, we may issue a refund at our discretion if requested within 7 days of billing. Contact maxupgradeteam@gmail.com for refund requests.
MaxUpgrade offers a referral program where users can earn free subscription time by inviting others. For every 3 users who sign up using your referral link, you receive 7 days of free subscription time added to your current plan.
Referral rewards are issued at our discretion and may be modified or discontinued at any time. Abuse of the referral system — including creating fake accounts, self-referrals, using bots, or spamming — will result in forfeiture of all referral rewards and possible account termination without refund.
You own the data you log in MaxUpgrade — workouts, journal entries, financial data, and all other personal information. By using the service, you grant us a limited license to process and store your data to provide the service.
We will not sell your data, use it to train third-party AI models, or share it with advertisers. See our Privacy Policy for full details on how your data is handled.
Eve's responses are generated by an AI and are for informational and motivational purposes only. AI-generated content may contain errors, inaccuracies, or outdated information. Do not make significant health, financial, or life decisions based solely on Eve's responses.
Supplement and nutrition recommendations are for informational purposes only. Consult your doctor before taking any supplements, especially if you have existing health conditions, are pregnant, or take medication.
Workout recommendations are general guidance and do not account for injuries, medical conditions, or physical limitations you may not have disclosed. Consult a qualified fitness professional or physician before beginning any exercise program.
Financial projections, retirement calculations, and savings recommendations are estimates based on the data you provide. They are not financial advice. Consult a licensed financial advisor for decisions involving investments, retirement planning, or significant financial commitments.
We are not responsible for any outcomes resulting from following AI-generated advice. Use your own judgment and consult professionals where appropriate.
MaxUpgrade displays exercise form demonstration videos that are embedded from YouTube using YouTube's official iframe embed mechanism. We do not host, download, modify, or own this video content. All embedded videos remain the intellectual property of their respective creators and YouTube.
Attribution is provided in every demonstration card showing the source channel name. Embedded videos link directly back to the original creator's content on YouTube. We are not affiliated with, endorsed by, or sponsored by any of the creators whose videos we embed, and no implication of partnership should be inferred.
When you watch an embedded video, YouTube's Terms of Service and Privacy Policy apply to that interaction. YouTube may collect viewing data, serve advertisements, and apply cookies as described in their own policies — separate from MaxUpgrade's data practices.
If you are a content creator and wish to have your video removed from MaxUpgrade, contact us at maxupgradeteam@gmail.com. We will remove the embed within 5 business days of receiving a valid request. We respect the rights of content creators and will honour all reasonable removal requests.
If an embedded video becomes unavailable — for example, if the creator deletes it or disables embedding — MaxUpgrade is not responsible for the unavailability. A fallback YouTube search link is provided so users can locate alternative form demonstrations.
You agree not to: · Use the service for any illegal purpose · Attempt to reverse engineer, scrape, or extract data from the platform · Use the service to harm, harass, or defraud others · Share your account with others or resell access · Circumvent any technical restrictions or security measures · Upload malicious content or attempt to compromise the platform's security · Abuse the AI coach by attempting to generate harmful, illegal, or inappropriate content
Violation of these terms may result in immediate account termination without refund.
You agree to indemnify and hold harmless MaxUpgrade, its owner, affiliates, and service providers from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.
MaxUpgrade is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
Our total liability to you for any claim arising from these terms or your use of MaxUpgrade shall not exceed the amount you paid us in the 3 months preceding the claim.
These terms are governed by the laws of the State of Illinois, United States. Any disputes arising from these terms shall be resolved in the courts of Illinois. If any provision of these terms is found to be unenforceable, the remaining provisions remain in full effect.
